1. SMS Messaging Terms & Compliance

By providing your mobile phone number and opting in to receive text messages from Savvital LLC, you agree to these SMS Messaging Terms. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except with service providers required to deliver the messages you have consented to receive.

2. Introduction / Acceptance of Terms

By accessing or using the services, website, or communications of Savvital LLC ("Savvital," "the Company," "We," "Us," or "Our"), you accept and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our services. These Terms apply to clients and users located in the United States and Canada.

Savvital LLC is a marketing agency and technology services company. Savvital LLC does not provide healthcare, medical, chiropractic, or clinical services of any kind, and nothing in these Terms should be construed as such.

4. Services and Communications

Our services may include marketing campaign management, CRM configuration and automation, lead generation support, appointment scheduling, and related communications delivered via phone, email, and SMS. By engaging our services, you consent to receive communications related to the services you have requested.

5. Client / User Responsibilities

As a client or user of our services, you agree to:

  • Provide accurate, current, and complete information when engaging our services
  • Use our services only for lawful business purposes
  • Maintain the confidentiality of any account credentials provided to you
  • Promptly notify us of any unauthorized use of your account or services
  • Cooperate reasonably with our team to facilitate delivery of the services

6. Account, Access, and Information Accuracy

Where our services require you to create an account or provide access to third-party platforms, you are responsible for maintaining the accuracy of the information you provide and for the security of any credentials shared with us. Savvital LLC is not liable for issues arising from inaccurate, outdated, or incomplete information provided by you.

7. SMS Communications

Transactional SMS Consent

By providing your mobile number, you consent to receive transactional text messages from Savvital LLC related to your account, inquiries, orders, projects, or services you have requested, including appointment reminders, order confirmations, project updates, account notifications, service updates, and billing notifications.

Marketing and Promotional SMS Consent

Where you have separately opted in, you consent to receive marketing and promotional text messages from Savvital LLC, including special offers, discounts, service updates, business updates, and new product or service announcements. This consent is not required as a condition of any purchase.

Age Restriction

You must be at least 18 years old, or the age of majority in your jurisdiction, and legally competent to enter into these Terms, in order to opt in to receive SMS communications from Savvital LLC or otherwise use our services.

8. Privacy Policy & SMS Compliance

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except with service providers required to deliver the messages you have consented to receive. 9. Payment and Billing

Fees for services are set out in the applicable service agreement or proposal provided to you. Invoices are due according to the terms specified in your agreement. Late payments may result in suspension of services. All fees are non-refundable unless otherwise stated in a signed agreement.

10. Service Agreements, Proposals, and Scope Changes

Specific deliverables, timelines, and pricing for our services will be outlined in a separate service agreement, proposal, or statement of work. Any changes to the agreed-upon scope of services must be made in writing and may result in adjustments to fees or timelines.

11. Third-Party Platforms and Client Accounts

Delivery of our services may require access to third-party platforms, tools, or accounts that you own or control, such as CRM systems, advertising accounts, or website hosting. You are responsible for maintaining active licenses or subscriptions to these platforms, and we are not responsible for service interruptions caused by third-party platform outages, policy changes, or account suspensions.

12. Advertising, Campaigns, and Performance Disclaimer

While we use industry best practices to plan and manage marketing and advertising campaigns, we do not guarantee specific results, lead volumes, conversion rates, rankings, or return on investment. Marketing performance can be affected by numerous factors outside of our control, including market conditions, platform algorithm changes, and competitor activity.

13. Client Content and Materials

You represent and warrant that any content, materials, trademarks, or information you provide to us for use in our services do not infringe upon the intellectual property or other rights of any third party. You grant Savvital LLC a limited license to use such materials solely for the purpose of delivering the services you have requested.

14. Intellectual Property Rights

All content, materials, trademarks, and technology associated with Savvital LLC and our services, excluding client-provided materials, are owned by Savvital LLC or our licensors and are protected by applicable intellectual property laws. You may not use our name, logo, or content without our prior written permission.

15. User Feedback and Content

If you provide feedback or suggestions regarding our services, you grant Savvital LLC a worldwide, royalty-free license to use and display such content, except for personal information, which is handled under our Privacy Policy.

You agree not to use our services to:

Our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific business results, lead volumes, or marketing outcomes.

To the fullest extent permitted by law, Savvital LLC and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services.

21. Indemnification

You agree to indemnify and hold harmless Savvital LLC from any claims, losses, liabilities, or damages, including reasonable attorneys' fees, arising out of your violation of these Terms or misuse of our services.

22. Termination
